it may breach your constitutional rights…if both the facebook user and the boss were in the US. Not all facebook users are american. As for breching terms of service, well FB would need to take action against the boss, if they could be bothered.

Your probably all wrong on the lawsuit/rights thing -most states are ‘at will’ states, and during a trial period, you are under contract and subject to release without any cause whatsoever. (and making public derogatory remarks about your boss is a pretty da*# good reason).
